Terms of Service

Last Updated: October 15, 2026

Overview

This website is operated by White Winds Farm, LLC, doing business as White Winds Farm Equestrian Center ("White Winds Farm," "we," "us," or "our").

These Terms of Service ("Terms") govern access to and use of our website, online scheduling system, and related online services, as well as general conditions applicable to riding instruction, horse training, boarding, virtual instruction, and other equestrian services offered by White Winds Farm (collectively, the "Services").

By accessing our website, scheduling an appointment, purchasing a service, or entering into a service arrangement with White Winds Farm, you agree to these Terms to the extent applicable to your use of the website or Services.

Certain activities require additional agreements, including participation and liability waivers, registration forms, boarding agreements, and other service-specific documents. Those agreements supplement these Terms and govern the matters they specifically address. In the event of a conflict, the applicable signed agreement controls for that particular service.

If you do not agree to these Terms, you should not use our online services or make a booking through our website.

Section 1 – Eligibility and Participation by Minors

Individuals must be at least 18 years old to independently establish a service arrangement, purchase lessons or packages, or complete participation agreements with White Winds Farm.

Parents or legal guardians must complete the required registration documents, liability waivers, and authorizations for participants under 18.

Minors may browse publicly accessible portions of our website but may not independently enter into service agreements or submit required participation documentation without appropriate parental or guardian involvement.

All participants must satisfy applicable registration, safety, and participation requirements before engaging in equestrian activities.

Section 2 – Services Offered

White Winds Farm provides equestrian services that may include:

  • Riding lessons and instruction.

  • Horse training and related services.

  • Horse boarding and care arrangements.

  • Virtual riding instruction.

  • Riding video evaluations through Critique My Ride.

  • Other equestrian activities or services described on our website or agreed upon separately.

Services are subject to instructor availability, horse suitability, facility conditions, scheduling limitations, and other operational considerations.

Descriptions, availability, and pricing may change. Information displayed on our website is intended to describe current offerings but does not guarantee the availability of a particular instructor, horse, appointment, or service.

Section 3 – Online Scheduling and Client Accounts

White Winds Farm uses Acuity Scheduling, a third-party appointment scheduling platform, to manage lesson appointments, client accounts, packages, and certain online transactions.

When scheduling an appointment, you agree to provide accurate contact information and any other information reasonably required to administer the booking.

You are responsible for maintaining the confidentiality of your account credentials and for notifying the appropriate provider if you suspect unauthorized access to your account.

A booking request or online confirmation does not override applicable participation requirements, eligibility restrictions, or safety decisions made by White Winds Farm.

Appointments may need to be adjusted because of weather, horse welfare, instructor availability, facility conditions, or other circumstances affecting the safe or practical delivery of Services.

Section 4 – Pricing, Payments, and Purchases

White Winds Farm accepts payments online and in person.

Online purchases, lesson packages, and appointment-related payments may be processed through Acuity Scheduling and integrated third-party payment providers.

Prices and payment requirements are those communicated or displayed for the applicable service at the time of booking or purchase, unless otherwise agreed in writing.

Clients agree to provide accurate billing information and to pay applicable charges for Services purchased or received.

Boarding, training, and other ongoing service arrangements may be subject to separate payment schedules and terms established in their respective agreements.

White Winds Farm may correct pricing or billing errors and will communicate material changes affecting an existing purchase or booking.

Payment processing services may impose their own terms and conditions.

Section 5 – Cancellations, Rescheduling, and Refunds

Appointment cancellations, rescheduling requests, missed lessons, package expiration dates, and refund eligibility are governed by the policies communicated for the applicable service or purchase, including any terms displayed through the scheduling system.

Clients are responsible for reviewing applicable booking conditions before completing a purchase.

White Winds Farm may cancel or reschedule activities when necessary because of unsafe weather, horse health or welfare concerns, instructor unavailability, facility conditions, or other operational circumstances.

When White Winds Farm cancels a scheduled service, any applicable rescheduling, credit, or refund arrangement will be communicated in accordance with the terms of the purchase and applicable law.

Separate boarding, training, or other service agreements may establish additional cancellation, termination, and payment provisions.

Nothing in these Terms limits any refund or consumer rights that cannot lawfully be waived.

Section 6 – Equestrian Activities and Inherent Risks

Horseback riding, horse handling, and other equestrian activities involve inherent risks.

Horses are living animals whose behavior may be unpredictable. Risks may include falls, kicks, bites, collisions, sudden movements, equipment-related incidents, and reactions to sounds, objects, people, other animals, or environmental conditions.

Participants and, where applicable, their parents or legal guardians are responsible for reviewing and completing required participation agreements and acknowledgments of risk.

North Carolina Equine Activity Liability Warning

WARNING

Under North Carolina law, an equine activity sponsor or equine professional is not liable for an injury to or the death of a participant in equine activities resulting exclusively from the inherent risks of equine activities. Chapter 99E of the North Carolina General Statutes.

This warning reflects North Carolina law and does not eliminate liability in circumstances where the law provides otherwise.

The warning's appearance on this website does not replace any required warning signs or notices in applicable written contracts.

Section 7 – Safety Rules and Participant Responsibilities

Participants must follow reasonable instructions from White Winds Farm personnel concerning horse handling, riding, equipment, facility access, and general safety.

Participants are expected to:

  • Follow instructor directions and posted facility rules.

  • Wear appropriate riding attire and required protective equipment.

  • Use horses and equipment only as authorized.

  • Treat horses, staff, students, and visitors respectfully.

  • Disclose information reasonably relevant to safe participation.

  • Refrain from unsafe, abusive, reckless, or disruptive conduct.

  • Respect restricted areas and facility boundaries.

White Winds Farm may modify, suspend, or discontinue an activity when reasonably necessary to protect participants, horses, staff, or others.

An instructor may determine that a particular horse, exercise, or activity is unsuitable for a participant based on experience, ability, safety, or animal welfare considerations.

Section 8 – Minor Athlete Safety and Safeguarding

White Winds Farm is SafeSport Certified and recognizes the importance of maintaining an appropriate and safe environment for minor participants.

SafeSport training and safeguarding principles address abuse prevention, misconduct, appropriate adult-minor interactions, and reporting responsibilities in athletic settings.

Parents or legal guardians are responsible for completing required registration and participation authorizations for minors and providing accurate emergency contact information.

All participants, visitors, and other individuals interacting with the facility are expected to behave appropriately and respect applicable safeguarding and safety requirements.

Concerns involving participant safety, suspected abuse, or misconduct may be addressed through appropriate reporting channels and, where required, reported to the relevant authorities.

Nothing in these Terms restricts an individual's right or obligation to report suspected abuse, misconduct, or unlawful conduct.

Section 9 – Health Information and Emergency Situations

Participants and parents or legal guardians are responsible for providing accurate information reasonably requested for registration, emergency preparedness, and participation safety.

White Winds Farm may contact emergency services or appropriate medical professionals when an accident, injury, or other emergency occurs.

Emergency treatment authorizations, responsibility for associated expenses, and related matters may be addressed in separate participation or registration documents.

White Winds Farm does not provide medical diagnoses or treatment through its ordinary equestrian instruction services.

Section 10 – Horse Boarding and Training

Horse boarding, training, and related care arrangements are subject to availability and any separate written agreements applicable to those services.

Such agreements may address:

  • Boarding or training fees and payment schedules.

  • Horse ownership and identification.

  • Veterinary records and vaccination requirements.

  • Feeding, turnout, medication, and care arrangements.

  • Emergency veterinary authorizations.

  • Farrier and veterinary services.

  • Owner responsibilities.

  • Termination, removal, or transfer of horses.

  • Other terms specific to the care or training arrangement.

Horse owners are responsible for providing accurate information concerning their horses, including relevant medical history, behavioral concerns, and care instructions.

White Winds Farm may take reasonable action in response to urgent horse welfare or safety concerns, subject to applicable law and the terms of any relevant agreement.

These website Terms do not replace a separately executed boarding or training contract.

Section 11 – Virtual Instruction and Critique My Ride

White Winds Farm may provide virtual riding instruction, recorded video evaluations, or instructional feedback through Critique My Ride and related Services.

Clients are responsible for submitting recordings that reasonably show the riding activity they wish to have evaluated and for providing relevant background information.

Virtual instruction and video critiques are based on the information and footage made available to the instructor. They do not provide the same opportunity for direct observation, intervention, or supervision as in-person instruction.

Recommendations may be limited by video quality, camera angles, incomplete information, or circumstances not visible in a recording.

Clients remain responsible for selecting appropriate horses, equipment, facilities, and riding conditions, and for exercising reasonable judgment concerning their own abilities and safety.

Virtual feedback does not guarantee a particular training result or eliminate the risks associated with equestrian activities.

Section 12 – Photographs, Videos, and Client Submissions

Clients retain their rights in photographs, videos, and other original materials they submit, subject to any applicable third-party rights.

By submitting materials for instructional purposes, clients authorize White Winds Farm to access, review, and use those materials as reasonably necessary to deliver the requested Service.

Clients are responsible for ensuring they have the necessary rights or permissions to submit recordings or other materials, including appropriate authorization concerning identifiable minors or other individuals appearing in submitted content.

White Winds Farm obtains appropriate permission before publishing identifiable client photographs or footage for promotional purposes. For minors, such promotional use requires parent or legal guardian authorization.

Submission of a riding video for private instructional review does not, by itself, constitute permission for public or promotional use.

Clients may not submit unlawful, abusive, infringing, or otherwise inappropriate content.

Section 13 – Intellectual Property

Unless otherwise indicated, the website's text, photographs, graphics, branding, instructional materials, and other original content are owned by White Winds Farm or used with permission.

Visitors may access website content for ordinary personal and informational use.

No portion of the website or its original content may be reproduced, republished, sold, distributed, or commercially exploited without appropriate authorization, except as permitted by law.

Clients may use instructional feedback and materials provided specifically to them for their own personal riding education and training, subject to any additional terms communicated for the Service.

Nothing in these Terms transfers ownership of client-submitted photographs or videos to White Winds Farm.

Section 14 – Third-Party Services and Links

Our website may use or link to third-party services, including Squarespace, Acuity Scheduling, payment processors, analytics providers, and social media platforms.

These providers may operate under their own terms, policies, and privacy practices.

White Winds Farm does not control independently operated third-party websites or services and is not responsible for their separate content, availability, or business practices.

Clients should review relevant third-party terms when using those services.

Section 15 – Personal Information and Privacy

Our collection, use, and disclosure of personal information are described in our Privacy Notice, available on our website here.

Information submitted through scheduling, registration, payments, or other third-party services may also be processed under those providers' applicable privacy policies.

Questions concerning personal information may be directed to whitewinds2246@gmail.com.

Section 16 – Website Accessibility

White Winds Farm seeks to make its website reasonably accessible and usable. You may view our Accessibility Statement here.

If you experience difficulty accessing website information or completing an online inquiry or booking, please contact us at whitewinds2246@gmail.com so we can consider an appropriate alternative or assistance.

Section 17 – Accuracy of Website Information

We make reasonable efforts to provide accurate information concerning our Services, pricing, scheduling, and facility operations.

However, website content may occasionally contain errors, omissions, or outdated information.

White Winds Farm may correct inaccurate information, update service descriptions, or modify website content as necessary.

Material changes affecting an existing confirmed purchase or contractual arrangement will be handled in accordance with applicable terms and law.

Section 18 – Prohibited Website Uses

Visitors may not use our website or online services to:

  • Engage in unlawful or fraudulent conduct.

  • Submit false or misleading information.

  • Harass, threaten, or abuse others.

  • Infringe intellectual property or privacy rights.

  • Upload malicious software or interfere with website security.

  • Attempt unauthorized access to accounts or systems.

  • Collect personal information about others without authorization.

  • Disrupt or misuse scheduling or payment systems.

  • Submit material that exploits or endangers minors.

We may restrict access to online services in response to misuse, subject to applicable law.

Section 19 – Disclaimer of Warranties

Website information and online functionality are provided on an "as available" basis.

While we make reasonable efforts to maintain our website and online services, we cannot guarantee uninterrupted access, error-free operation, or continuous availability of third-party scheduling and payment systems.

Instructional services are provided with the objective of supporting rider development, but individual progress depends on numerous factors, including experience, practice, horse suitability, and circumstances beyond the instructor's control.

We do not guarantee specific competitive results, riding achievements, or training outcomes.

Nothing in this section disclaims obligations or warranties that cannot lawfully be excluded.

Section 20 – Limitation of Liability

To the extent permitted by applicable law, White Winds Farm is not responsible for indirect or consequential losses arising solely from website outages, technical errors, or interruptions of third-party online services.

Liability relating to participation in equestrian activities is governed by applicable law, including North Carolina General Statutes Chapter 99E, and any applicable participation agreements or liability waivers.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by law, including circumstances falling within statutory exceptions to equine activity liability protections.

These Terms do not independently establish a blanket release of liability for physical injury, death, or property damage.

Section 21 – Indemnification

To the extent permitted by applicable law, users are responsible for losses or third-party claims arising from their unlawful use of the website, infringement of another person's rights, or intentional misuse of online services.

Any indemnification obligations concerning participation in equestrian activities, horse ownership, boarding, or training are governed by the applicable separately executed agreements and enforceable law.

Section 22 – Suspension or Termination of Services

White Winds Farm may suspend or discontinue access to online services or decline future bookings for legitimate business, safety, or conduct-related reasons, subject to applicable law and existing contractual obligations.

Participation may be suspended when an individual's conduct creates an unreasonable safety concern for people or horses.

Termination of boarding, training, or other ongoing arrangements is governed by the applicable written agreement and relevant law.

Termination does not automatically eliminate payment obligations or other responsibilities properly incurred before termination.

Section 23 – Events Beyond Our Control

White Winds Farm may experience delays, interruptions, cancellations, or temporary closures because of events beyond its reasonable control, including severe weather, natural disasters, public emergencies, utility failures, facility damage, internet outages, or other extraordinary circumstances.

The health and welfare of horses and the safety of participants may also require adjustments to scheduled activities.

Any resulting rescheduling, credits, refunds, or contractual obligations will be addressed in accordance with the applicable service terms and law.

Section 24 – Governing Law and Disputes

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.

If a dispute arises concerning website use or Services, the parties are encouraged to attempt to resolve the matter through good-faith communication before pursuing formal proceedings.

Any legal action will be subject to the jurisdiction and venue requirements of applicable law and any enforceable provisions of a separate written agreement.

Nothing in these Terms prevents an individual from reporting safety concerns, suspected abuse, or unlawful conduct to appropriate authorities or exercising rights that cannot legally be waived.

Section 25 – Electronic Communications and Agreements

By providing contact information or using our online scheduling system, clients may receive electronic communications concerning bookings, payments, registration, and related Services.

Electronic signatures and records may be used for applicable agreements and authorizations to the extent permitted by law.

Certain documents may require additional verification, parental or guardian authorization, or separate execution.

Section 26 – Relationship to Other Agreements

These Terms establish general conditions for website use and White Winds Farm's online services.

Separate registration forms, participation agreements, liability waivers, boarding contracts, training agreements, and other service-specific documents may establish additional rights and responsibilities.

Where a separate signed agreement conflicts with these Terms concerning the particular service it governs, the signed agreement controls, except where applicable law requires otherwise.

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Failure to enforce a provision on one occasion does not necessarily waive the right to enforce it later.

Section 27 – Changes to These Terms

White Winds Farm may update these Terms to reflect changes in website functionality, Services, business operations, or applicable law.

Updated Terms will be posted on our website with a revised date.

Changes will apply prospectively to the extent required by law and will not automatically override existing signed agreements or previously established contractual rights.
